We urge the UK Government to protect Local Planning Authorities (LPAs) from the threat of Judicial Review when they refuse inappropriate planning applications. The National Scheme of Delegation and rigid Gateway Tests are stripping away local democratic oversight and silencing communities.

We urge the UK Government to repeal the National Scheme of Delegation and the Gateway Test, and to protect Local Planning Authorities (LPAs) from Judicial Review when they refuse harmful applications. These top-down rules strip local councils of democratic oversight, silencing communities and forcing authorities to wave through developments out of fear of costly legal challenges. The Gateway Test fails to protect climate, nature, or local people, serving only to fast-track development. We call on Parliament to scrap these mechanisms and restore true local planning powers.
