Make prenuptial agreements unenforceable for domestic abuse victims — 11 signatures. Status: open.
Perpetrators of domestic abuse can use prenuptial agreements as a form of financial control. Especially in coercive control cases. We think prenuptial agreements should not be allowed to stand up in court when there is clear evidential domestic abuse.
Financial abuse is one of the most commonly used tactics in coercive control. It serves to make victims financially reliant on them so they are powerless to leave. Prenuptial agreements are not legally binding in the UK but can be highly persuasive. In our view, the threshold for conduct to be taken in to consideration is so incredibly high that it is almost impossible to have them overturned and yet it leaves victims vulnerable and at a significant disadvantage.
