End the Loss of Rights During Immigration Judicial Review — 10 signatures. Status: open.
Judicial review may expose an unlawful Home Office decision, yet claimants can lose the right to work, rent and support their families while the case is pending. Access to justice is hollow if pursuing it destroys the stability needed to see the challenge through.
A person may lawfully challenge a Home Office decision by judicial review yet lose the right to work, rent and support their family while the case is pending. This can happen before a court has decided whether the Home Office acted lawfully. We ask the Government to introduce temporary statutory protection preserving previous immigration rights for genuine judicial review claimants until the challenge is finally determined.
