A criminal threshold for free speech. — 14 signatures. Status: rejected.
Criminalise speech only if it is directed to inciting imminent lawless action and is likely to produce it, or is a true threat. Repeal or amend low-threshold laws (Public Order Act s.5, Communications Act s.127 and similar) so offence, insult and unpopular views are not crimes.
Speech should be a crime only where it is directed to inciting imminent lawless action and likely to produce it, or is a genuine true threat. Offence, insult, alarm, distress or “grossly offensive” opinion must not suffice. Amend or repeal Public Order Act s.5, Communications Act s.127, malicious communications rules and similar low-threshold offences. Align CPS and police guidance with this higher bar so scarce resources target real harm, not lawful debate, protest or online dissent.
