The Supreme Court's 2025 judgment interpreted "sex", "man" and "woman" in the Equality Act 2010 as biological sex and considered section 9 of the Gender Recognition Act 2004. Parliament should examine whether this interpretation reflects the legislation and the parliamentary record when these Acts were passed. We ask the Government to compare the judgment with Hansard, ministerial statements and explanatory material, particularly concerning section 9's "for all purposes" provision.
