The EHRC's guidance published 21.05.2026 threatens the safety and dignity of all trans people, increasing their risk of experiencing harassment and violence, and also increasing the same risks to cisgender women (whom it was designed to protect).

Additional details

The EHRC's guidance is unconstitutional in that it contradicts an act of Parliament (the Gender Recognition Act 2004), and weakens physical and legal protections for transgender people, who remain a protected demographic under the Equality Act 2010. The guidance feeds into and legitimises anti-trans rhetoric that has been increasing in the last 10 years, and could be seen as inciting hate crimes and discrimination. It is neither effective nor proportionate in protecting (cisgender) women.
